Susan Neill-Fraser had been granted right to appeal her murder conviction for the 2009 death of partner Bob Chappell, after Hobart Supreme Court judge, Justice Michael Brett confirmed ‘fresh and compelling’ had come to light.
The evidence centres around the DNA and a confession by Meaghan Vass, a homeless teen, who had previously signed a statement saying she was a witness to Chappell’s murder, before retracting.
Earlier this month, Vass appeared on an episode of 60 Minutes, where she re-confirmed her claims that she witness an ex-boyfriend and another man bludgeon Chappell to death in a robbery gone wrong.
Neill-Fraser maintain’s she wasn’t on the luxury yacht at the time of the murder, and the businessman’s body has never been found.
“The fresh and compelling evidence to which this decision refers is the evidence of the out of court representations of Ms Vass,” Justice Brett said, reports Daily Mail.
‘The principal piece of evidence providing such context, of course, is the location of Ms Vass’s DNA on the yacht, and what (forensic scientist) Mr Maxwell Jones has now had to say about that DNA.’
