A British grandmother has been granted the right to carry her dead daughter’s babies after she won a world first appeal.
The 60-year-old woman, known only as Mrs. M, has been fighting to use her daughter’s eggs for the last five years, The New York Post reports.
‘The woman lost an action at the High Court last year, but continued her battle in the Court of Appeal,’ says The Telegraph, London.
She claims her daughter, who tragically passed away from bowel cancer at 29, desperately wanted children. As he dying wish the daughter told her mum: “carry my babies”.
Mrs M couldn’t find a clinic to impregnate her with the eggs in the UK, but had more luck in the US.
In court, The Human Fertilization and Embryology Authority (HFEA) said Mrs M needed written consent from her daughter and was concerned about the risks.
A London court granted the woman to implant and carry the babies, and the HFEA were ordered to pay the parent’s legal costs, which are over $130,000.
