A Sydney Uber driver has pleaded not guilty after being accused of raping a 22-year-old woman who fell asleep in his car.
In October 2015 41-year-old Muhammad Naveed, stopped at a service station to buy condoms before having what he claims was “consent sex” with the heavily intoxicated passenger after picking her up after a night out in Kings Cross.
On the opening day of his trial in the NSW District court, crown prosecutor, James Trevallion told the jury that the British nanny had been drinking with friends at several venues, before getting into what she thought was a taxi.
The court heard that after pulling over to buy condoms and a bottle of water, Naveed turned to the woman and said, “I’ve just got these.”
“She became confused… and did not really understand why the accused was showing her this packet of condoms,” Travillion said.
The woman was unable to keep her eyes open and began falling asleep. The next thing she remembers is waking up to find Naveed on top of her.
“She did not have the strength to be able to push him off,” Travallion said.
The woman then fell asleep again after the alleged assault and Naveed dropped her home at her Eastern suburbs residence. It was there that she phoned a friend and reported the incident to police.
After his arrest a few days later, Naveed told police the sex was consensual.
“I asked her a few times and she said yes,” he said.
The trial is set to continue on Friday.
